OVERVIEW This website is operated by Gem Plant Sales Ltd trading as Wackershop. Throughout the site, the terms “we”, “us” and “our” refer to Gem Plant Sales Ltd. By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions.

2. CONTRACT FORMATION

Your order constitutes an offer to us to buy a product. After placing an order, you will receive an acknowledgement email. Please note that this does not mean your order has been accepted. Acceptance of your order and the formation of the contract takes place only when the goods are dispatched. We reserve the right to cancel any order prior to dispatch for reasons including, but not limited to, pricing errors or stock unavailability.

3. PRICING AND PAYMENT

  • Currency: All prices are in GBP (£).

  • VAT: Prices displayed on the website include VAT at the prevailing UK rate unless otherwise stated.

  • Errors: In the event that a product is listed at an incorrect price due to a typographical or technical error, we reserve the right to refuse or cancel any orders placed.

4. DELIVERY AND TITLE

Any delivery dates provided are estimates only. While we aim to deliver within the timeframe indicated, Gem Plant Sales Ltd shall not be liable for any losses, costs, or damages caused by a delay in delivery. Risk in the products passes to you upon delivery, but ownership (title) only passes once we have received full payment.

5. PRODUCT SPECIFICATIONS (MACHINERY & PARTS)

Products are sold for the purposes described by the manufacturer. While we strive for accuracy, images on the site are for illustrative purposes. We do not warrant that the results obtained from the use of equipment purchased will be accurate or reliable for every specific application. It is the buyer's responsibility to ensure the equipment is suitable for their specific site requirements.

6. LIMITATION OF LIABILITY

PLEASE READ THIS SECTION CAREFULLY. To the maximum extent permitted by law, Gem Plant Sales Ltd (T/A Wackershop) shall not be liable for:

  • Any indirect, incidental, or consequential damages (including loss of profit, loss of business, or depletion of goodwill).

  • Any injury or damage to property arising from the misuse of machinery or failure to follow manufacturer safety guidelines.

  • Our total liability in contract, tort, or otherwise shall be limited to the price of the goods paid by the customer.

Nothing in these terms excludes our liability for death or personal injury caused by our negligence.

7. CANCELLATIONS AND RETURNS (UK CONSUMER RIGHTS)

  • B2C (Consumer) Sales: Under the Consumer Contracts Regulations, you have the right to cancel your order within 14 days of receiving the goods. Goods must be returned in their original, unused condition.

  • B2B (Business) Sales: If you are purchasing on behalf of a business, the 14-day "cooling off" period does not apply. Returns for business customers are at our sole discretion and may be subject to a restocking fee.

  • Special Orders: Parts or machinery ordered specifically to your requirements (Non-Stock Items) may be non-returnable.

8. GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
